COMMISSION Terms and conditions

1. Introduction

These Terms and Conditions govern the provision of photography and videography services ("Services") by PHOTOMAFIA Studios ("Company," "we," "us," or "our") to the client ("Client," "you," or "your"). By commissioning our services, you agree to be bound by these terms. Please read them carefully.

2. Services

2.1 Scope of Services: PHOTOMAFIA Studios provides custom photography and videography services as per the project requirements agreed upon between the Client and the Company.

2.2 Project Specifications: The details of the project, including the scope, deliverables, deadlines, and costs, will be outlined in a separate contract or project brief. Any changes to the agreed-upon services must be confirmed in writing and may be subject to additional charges.

3. Booking and Payment

3.1 Booking: A non-refundable deposit of 50% of the total fee is required to secure your booking. The remaining balance is due 5 days before the scheduled service date unless otherwise agreed.

3.2 Payment Terms: Payments can be made via Debit, Credit, or Transfer. Late payments may incur a 20% fee per day overdue.

3.3 Cancellation Policy: If you need to cancel your booking, you must do so in writing. If the cancellation occurs within [Number] days of the scheduled service, you will be liable for [Percentage]% of the total fee. The deposit is non-refundable.

4. Delivery of Services

4.1 Delivery Timeframe: The final deliverables will be provided within 14 days after the completion of the project. Delivery times may vary depending on the project scope.

4.2 Revisions: The Client is entitled to 10 revisions of the final deliverables. Additional revisions may incur extra charges.

4.3 Format of Deliverables: Deliverables will be provided in the format agreed upon in the project brief. This may include digital files, prints, or other media.

5. Intellectual Property

5.1 Ownership: PHOTOMAFIA Studios retains all rights, titles, and interests in and to the photographs, videos, and other materials created during the project. Upon full payment, the Client is granted a non-exclusive, non-transferable license to use the deliverables for personal or commercial purposes as specified in the project brief.

5.2 Usage Rights: The Client may not resell, re-license, or otherwise distribute the deliverables without written permission from PHOTOMAFIA Studios. The Client is responsible for obtaining any necessary permissions for the use of the deliverables in third party publications or platforms.

5.3 Portfolio Use: PHOTOMAFIA Studios reserves the right to use the deliverables for promotional purposes, including but not limited to portfolios, websites, social media, and marketing materials, unless otherwise agreed in writing.

6. Client Responsibilities

6.1 Access and Cooperation: The Client agrees to provide necessary access to locations, individuals, and materials required to complete the services. The Client is also responsible for ensuring that all necessary permissions and permits are obtained.

6.2 Content Approval: The Client must review and approve content before final delivery. Failure to provide feedback within the agreed timeframe will be considered acceptance of the deliverables.

7. Liability

7.1 Limitation of Liability: PHOTOMAFIA Studios is not liable for any indirect, incidental, or consequential damages arising out of or in connection with the services provided. Our liability is limited to the amount paid by the Client for the specific project.

7.2 Force Majeure: PHOTOMAFIA Studios is not liable for delays or failures in performance due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, and equipment failures.

8. Confidentiality

Both parties agree to keep confidential all information, data, and materials provided by the other party that are designated as confidential.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of United kingdom. Any disputes arising under these terms shall be resolved in the courts of United kingdom.

10. Amendments

PHOTOMAFIA STUDIOS reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to the Client and will apply to future commissions.
